Statute of the Museum-Zamek in Łańcut

 
Chapter 1

General provisions
§ 1. The Museum - Łańcut Castle, hereinafter referred to as the "Museum", is a cultural institution run as a joint cultural institution of the Minister responsible for culture and national heritage protection, hereinafter referred to as the "Minister", and the Podkarpackie Province, hereinafter referred to as the "Province", operating in particular on the basis of:
The Law of November 21, 1996 on museums (Journal of Laws of 2012, item 987 and 1086), hereinafter referred to as the "Law on museums";
Act of October 25, 1991 on organizing and conducting cultural activities (Journal of Laws of 2017, item 862), hereinafter referred to as the "Act on organizing and conducting cultural activities."
Agreement on operating as a joint cultural institution - Museum - Castle in Łańcut, concluded on September 2, 2005, hereinafter referred to as "the Agreement";
statute.
§ 2. 1. The Museum is entered in the register of cultural institutions kept by the Minister under the number RIK 67/2006.
(2) The museum is registered in the State Register of Museums kept by the Minister under number PRM/48/98.
3 The museum has legal personality.
§ 3. 1. The seat of the Museum is Łańcut.
(2) The area of operation of the Museum is the territory of the Republic of Poland and abroad.
§ 4. 1 The Museum shall use a round seal with the image of an eagle established for the emblem of the Republic of Poland and the name of the Museum in the rim in the following wording: "Museum - Castle in Łańcut".
(2) The museum may use the abbreviated name as follows: "Castle Łańcut".

Chapter 2

The scope of the museum and the type of collections collected
§ 5 The scope of the Museum's activities includes the protection and maintenance of the historical condition of the castle and park complex in Łańcut and the palace and park complex in Julin, including historic interiors, collections of works of art, historical objects, historical memorabilia, library collections, archives and historic landscape, as well as the protection of works of Orthodox art.
§ 6. The museum conducts its activities in particular by:
Collection of historical monuments and documentary materials within the statutorily defined scope, acquired through purchases, donations, bequests, deposits and transfers;
Inventorying, cataloging and scientific development of the collected collections;
making the collected collections available for scientific, educational and publishing purposes and sharing the results of ongoing research;
storage of collected antiquities, in conditions that ensure their safety, and storage in a manner that is accessible for scientific purposes;
Securing and preserving collections;
Organizing permanent and temporary exhibitions;
Organizing and conducting scientific research within the scope of the Museum's substantive activities;
Conducting cultural and educational activities in the form of concerts, theatrical performances, competitions, trainings, sessions and author meetings;
publishing catalogs, exhibition guides, information and advertising materials, from the scope of its activities, and scientific publications;
Lending and accepting monuments for deposit;
Maintaining a professional library and archive;
cooperation with Polish and foreign museums, government and local administration, cultural institutions, Polish and foreign scientific and research institutes, non-governmental organizations, as well as other legal entities, organizational units without legal personality and individuals.
§ 7 The museum collects and cares for collections of history, material culture and art, including garden art.
§ 8. The museum collects the following types of collections:
Painting, drawing, graphic arts;
arts and crafts;
sculptures;
objects and testimonies related to the history of the former Lubomirski and Potocki residences, the Łańcut Ordinance and the life and history of the Polish aristocracy and landed gentry;
historic buildings and natural heritage sites;
horse-drawn vehicles;
monuments related to the history of Lancut, the region and the 10th Horse Rifle Regiment;
church art;
Old prints, library and archival materials;
digital resources;
Postcards, photographs and photographic negatives;
content and historical and natural values, as well as intellectual and industrial property in the form of trademarks (verbal and graphic).

Chapter 3

Museum organization
§ 9 The organizational structure of the Museum includes a Branch - the Hunting Palace in Julin.
§ 10 The internal organization of the Museum, including the scope of tasks of organizational units, workstations and branches, is determined by the Organizational Regulations established by the Director of the Museum, after consultation with the Minister, the Province and the opinions of trade union organizations and artists' associations active in the Museum.

Chapter 4

Supervisory bodies, governing body and advisory bodies and how they are appointed
§ 11 The Minister shall supervise the Museum.
§ 12. 1. The museum is managed by the Director.
(2) The Director shall be appointed and dismissed by the Minister in agreement with the Province, in accordance with the procedure and principles set forth in the Law on the Organization and Operation of Cultural Activities, the Law on Museums and the provisions of the Agreement.
§ 13. 1. The Director is responsible for the proper implementation of the statutory activities and proper management of the property and financial resources of the Museum.
(2) The Director's responsibilities include, in particular:
Supervision of the collections and their recording, as well as of the Museum's assets;
Representing the Museum to the outside world;
Presentation of material and financial plans, reports and financial proposals to the Minister and the Province;
Supervising the editing of museum publications;
issuing orders;
Supervision of internal control;
Exercise of the powers provided for the entity that created the library, specified in separate regulations;
Entering into and terminating employment contracts with Museum employees and other civil law contracts;
Creating conditions that enable the Museum to plan and carry out defense tasks and tasks in the area of crisis management, as defined by separate regulations.
§ 14. 1. The Director shall manage the activities of the Museum with the assistance of a deputy.
(2) The Deputy shall be appointed and dismissed by the Director after consultation with the Minister and the Province.
§ 15. 1. There is a Museum Council attached to the Museum, consisting of 12 members.
(2) Members of the Museum Council shall be appointed by the Minister, with the proviso that at least one representative designated by the Minister and at least one representative designated by the Province shall be appointed to the Museum Council in accordance with Article 11(5)(1) of the Law on Museums.
(3) The Museum Council shall act within the scope and under the rules set forth in Article 11 of the Law on Museums.
§ 16. 1. The Museum may have advisory colleges established according to the principles set forth in Article 12, paragraph 1 of the Law on Museums.
(2) When creating an advisory college, the Director shall inform the Minister and the Province of his intention in this regard, who shall have the right to designate one of their representatives each to the composition of the college.
(3) The advisory college may be either permanent or established in connection with the implementation of a specific task.
(4) The scope of the advisory college and the number of members shall be determined by the Director.
(5) The advisory college shall be composed of substantive employees of the Museum or persons from outside the Museum.
(6) The members of the advisory college shall elect from among themselves the chairman of the college.
7. meetings of the advisory college shall be convened by the Director.
(8) The advisory college expresses its opinions in the form of resolutions adopted by a simple majority with the presence of at least half of the college. In the event of a tie, the vote of the chairman of the college shall be decisive.
(9) Minutes shall be taken of the meeting of the advisory college, which shall include the agenda of the meeting, the names of the members of the college present and the opinions expressed during the meeting.
10 The minutes shall be signed by the members of the advisory college present at the meeting.
(11) The service of the advisory college is provided by the Museum.

Chapter 5

Financial management of the Museum
§ 17. The funds needed for the maintenance and development of the Museum shall be provided by the Minister and the Province.
§ 18. 1. The Museum shall conduct financial management in accordance with the principles set forth in the Act on the organization and conduct of cultural activities and other applicable laws in this regard.
(2) The basis of the financial economy of the Museum is the financial plan established by the Director, while maintaining the subsidies received from the Minister and the Province.
(3) The assets of the Museum shall be used for the purposes arising from the scope of the Museum.
§ 19. the Museum disposes independently of assigned and acquired property and conducts independent management within the limits of its resources, guided by the principle of their effective use.
§ 20 The Director shall ensure the timely preparation of the annual mandatory audited financial statements and submission to the Minister for approval.
§ 21. The sources of funding for the Museum's activities are:
subsidies provided by the Minister and the Province, including:
Subject subsidies to subsidize current activities in the scope of statutory tasks, including maintenance and repair of facilities,
earmarked grants to finance or subsidize the costs of investment,
earmarked subsidies for the implementation of designated tasks and programs;
Revenue from operations, including from the sale of movable assets;
income from rental and lease of assets;
subsidies from the budget of local government units;
funds received from natural and legal persons and other sources.
§ 22. 1. The Museum may conduct, as an additional business activity according to the rules set forth in the applicable legislation, in the field of:
tourism-related services;
rental and lease of the Museum's movable and immovable assets;
services supporting education and its extracurricular forms;
training services;
Sales of publications, souvenirs and other products thematically related to the profile of the Museum;
Advertising, promotion and sponsorship services;
food services;
to organize cultural, scientific, educational events, screenings, performances, concerts, shows and conferences against payment;
charging fees for providing access to collections in particular for reproduction, filming, photography and copying.
(2) Income from business activities shall be used to finance the statutory activities of the Museum.
§ 23. 1. The Director is authorized to perform legal actions on behalf of the Museum, including the submission of statements of intent with respect to its property rights and obligations.
(2) The Director may appoint proxies to perform legal acts on behalf of the Museum, specifying the scope of the proxy.
(3) The granting and revocation of a power of attorney shall be disclosed in the register of cultural institutions kept by the Minister, except for powers of attorney for litigation.

Chapter 6

Final provisions
§ 24 Merger, demerger or liquidation of the Museum may be carried out by the Minister and the Province in accordance with the procedure and rules provided for in the applicable legislation and taking into account the provisions of the agreement.
§ 25.Amendments to the statute shall be made in accordance with the procedure specified for its adoption.
